TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the "Link my Lineup" application ("the App") and its integration with the Spotify Platform. By accessing or using the App, you agree to be bound by these Terms.

1. Definitions:
   1. “Spotify Content” means any content, data, information or material made available through the Spotify Platform, Spotify Service or by Spotify. This may include, among other things, sound recordings, short-form videos, cover art, musical works, podcasts, artist biographies, song lyrics, metadata, playlists, and user data including Spotify Personal Data.
   2. “Personal Data” means any data falling within the definition of “personal data” under the General Data Protection Regulation 2016/679 or any replacement legislation, as applicable and including the UK’s Data Protection Act 2018 (“GDPR”).
   3. “Spotify Platform” means Spotify's developer tools accessible (e.g. APIs, SDKs, Widgets) and documentation described on the Spotify Developer Website.
   4. “Spotify Service” means the service, websites, software applications and clients provided by Spotify.
   5. “Spotify Personal Data” means any Personal Data in respect of which Spotify or a Spotify Affiliate is a data controller, which we process in connection with the Spotify Developer Terms.
2. Eligibility:

   You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old.

3. Data privacy:

   We do not store any of your information on our servers. We collect information about the music you have saved on Spotify when you authorize us to access this data through the Spotify platform. We will process your data in accordance with our Privacy Policy.

4. Warranties and Representations:

   The App is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Your use of the App is at your sole risk. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

   You acknowledge that we do not make any warranties or representations on behalf of Spotify and expressly disclaim all implied warranties with respect to the Spotify Platform, Spotify Service and Spotify Content, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

   Spotify is a third party beneficiary of our terms of service and privacy policy and is entitled to directly enforce our terms of service.

5. Modification and Derivative Works:

   You are prohibited from modifying or creating derivative works based on the Spotify Platform, Spotify Service, or Spotify Content.

6. Decompiling and Reverse-Engineering:

   You are prohibited from decompiling, reverse-engineering, disassembling, and otherwise reducing the Spotify Platform, Spotify Service, and Spotify Content to source code or other human-perceivable form, to the full extent allowed by law.

7. Prohibited activities: You agree not to engage in any of the following prohibited activities: (a) using the App for any unlawful purpose; (b) violating any applicable laws or regulations; (c) infringing upon the rights of others, including intellectual property rights; (d) attempting to interfere with the proper functioning of the App; (e) accessing or using the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use and enjoyment of the App.
8. Limitation of liability:

   In no event shall Link My Lineup be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the App. We are responsible for the App and we disclaim any liability on the part of third parties (e.g., Spotify).

9. Indemnification:

   You agree to indemnify and hold harmless Link My Lineup, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or in connection with your use of the App or your violation of these Terms.

Please review these Terms carefully. By accessing or using the App, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

These Terms are effective as of the date of your acceptance and shall remain in effect until terminated by either party.
